Terms of Service

1. Introduction 

These Terms of Service (“Terms”) govern your access to and use of services, classes, products, and the website operated by Body Chalet LLC (“Body Chalet,” “we,” “us,” or “our”), located at 345 Anglers Drive, Suite C, Steamboat Springs, Colorado 80487. By creating an account, purchasing classes or products, registering for a class, opting into SMS messaging, or otherwise using our services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our services. 

2. Eligibility 

You represent that you are at least 12 years old. Minors (ages 12–17) must have a parent or legal guardian’s consent and complete the required online waiver and health questionnaire prior to participating in classes. 

3. Services and Products 

We offer in-person Pilates classes and private/small-group sessions at our Steamboat Springs location. We also sell products online. Service descriptions, schedules, instructor listings, and prices are posted on our website and may change. 

4. Accounts, Registration & Waiver 

  • Account: You may be required to create an account to register for classes, purchase packages or products, or enroll in memberships. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. 

  • Waiver & Health Representations: Prior to your first class (and as requested thereafter), you must complete our online waiver and health questionnaire. You represent that you are physically able to participate in Body Chalet classes and have disclosed any medical conditions or injuries. Consult a physician if you have health concerns. 

5. Purchases, Payment & Auto-Renewal 

  • Pricing: Prices for classes, packages, memberships, and products are as posted at the time of purchase. We reserve the right to change prices. 

  • Payment Methods: We accept the payment methods displayed at checkout. By providing payment information, you represent you are authorized to use the payment method. 

  • Stored Payment & Auto-Renewal: For memberships and subscriptions, you authorize us to store your payment method and to automatically charge the card on file for recurring payments until you cancel according to these Terms. 

6. Refunds, Credits, Transfers & Cancellation Policy 

  • Single Classes & Drop-Ins: Single-class purchases are nonrefundable but may be eligible for a credit at our discretion. 

  • Packages & Memberships: Class packages and memberships are generally nonrefundable. Unused classes may be credited to your account per package terms. Credits may have expiration dates as noted at purchase. 

  • Credits: When classes are credited, the credit may be used toward future classes or services according to the terms provided at purchase. 

  • Private Sessions: Private and small-group sessions are subject to the same cancellation rules as other classes unless a different agreement is made in writing. 

  • Cancellation & No-Show: You must cancel reservations within the timeframe posted on our scheduling system (e.g., 12 hours prior) to avoid forfeiture of the class or a charge. No-shows may result in forfeiture of the class or full charge. 

7. Class Conduct & Studio Rules 

  • Arrive on time; late arrival policy is posted and may limit participation for safety reasons. 

  • Follow instructor guidance and posted equipment instructions. 

  • No recording of classes or instructors without prior written consent. 

  • Body Chalet reserves the right to remove any participant for disruptive or unsafe behavior without refund. 

8. Online Sales & Shipping 

We sell retail products online. Product descriptions, shipping, returns, and exchange policies are posted on our website and apply to product purchases. 

9. SMS/Text Messaging Program (Twilio compliance) 

  • Program Description 

By opting in, you agree to receive recurring automated text messages from Body Chalet ("we," "us," "our") at the mobile number you provided. Messages may include appointment reminders, order updates, account alerts, promotional offers, customer support follow-ups, and class or schedule notices. Consent to receive these messages is not a condition of any purchase. 

  • Message Frequency 

You may receive up to 5 messages per week. Message frequency may vary depending on your activity and interactions with us. 

  • Message and Data Rates 

Message and data rates may apply. Charges are billed by and payable to your mobile service provider. Please contact your wireless carrier for details about your messaging plan. 

  • How to Opt Out and Get Help 

You can unsubscribe the SMS service at any time by replying STOP to any message we send you. After you send STOP, you will receive a one-time confirmation message, and no further messages will be sent. If you want to rejoin, you can sign up again using the original opt-in method or reply START. For help or more information at any time, reply HELP to any of our messages.   • Carrier Liability Disclaimer 

Carriers are not liable for any delayed or undelivered messages.

10. Privacy & Twilio Data Statement 

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. See our Privacy Policy for full details on data collection, use, and retention. 

11. Intellectual Property 

All website content, including text, images, logos, and materials, is owned or licensed by Body Chalet and protected by intellectual property laws. You may not reproduce or distribute our content without prior written permission. 

12. User Content 

By submitting reviews, photos, or other content, you grant Body Chalet a nonexclusive, royalty-free, worldwide license to use, reproduce, and display such content for marketing and promotional purposes. 

13. Assumption of Risk, Release & Limitation of Liability 

  • Assumption of Risk: Exercise and use of studio facilities involve inherent risks. By participating, you assume all risks associated with physical activity and use of equipment. 

  • Release: To the fullest extent permitted by law, you release Body Chalet and its owners, instructors, employees, and agents from any claims arising from your participation, except where caused by our gross negligence or willful misconduct. 

  • Limitation of Liability: Except as prohibited by law, Body Chalet’s total liability for any claim will be limited to the amount you paid to Body Chalet in the 12 months preceding the claim. We are not liable for indirect, incidental, special, punitive, or consequential damages. 

14. Indemnification 

You agree to indemnify and hold Body Chalet, its owners, instructors, employees, and agents harmless from any claims, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your negligent acts. 

15. Dispute Resolution & Arbitration 

These Terms are governed by Colorado law. You and Body Chalet agree to resolve disputes through binding arbitration administered by the American Arbitration Association (or another mutually agreed forum), to be held in Routt County (Steamboat Springs), Colorado. The arbitration will be on an individual basis; class or representative actions are prohibited. Judgment upon the arbitration award may be entered in any court of competent jurisdiction. 

16. Modifications to Terms 

We may modify these Terms at any time. Changes will be effective when posted on the website with a revised effective date. Continued use after the effective date constitutes acceptance. 

17. Severability 

If any provision is held invalid or unenforceable, the remaining provisions remain in effect. 

18. Miscellaneous 

  • Entire Agreement: These Terms and incorporated policies constitute the entire agreement between you and Body Chalet. 

  • Assignment: You may not assign these Terms without our written consent. We may assign in connection with a sale or transfer of assets. 

  • No Waiver: Failure to enforce any provision is not a waiver. 

19. Acknowledgment 

By creating an account, registering for a class, purchasing a product, or opting into SMS messaging, you acknowledge that you have read, understood, and agree to be bound by these Terms.
